Q: Brought these 2 working smallest dead Put in new batteries still dead

I've ordered 3 sets of these, and fortunately not had a problem with, any! I'm presuming you've checked that they can go on timer, but if that's not the problem then I would let the seller know, maybe that one isn't working, hope you get it sorted.

Q: Do the lights flicker or are they static when on

They are static , you can set a timer for them to come on / off they are beautiful at night time I bought them for inside my lanterns.
