can I set xmp profile with this cpu since xmp is "technically" overclocking but this is not a "K" (as in 10700K), or overclocking cpu?

Yes, you can enable XMP if you have a Z board even though the CPU isn't a K model. I have my 3200 mhz ram running on a Z490 (at 3200 mhz) with a non-K CPU until I can afford the 10700K. I don't know why 2 people are telling you this is a "overclock CPU as it clearly isn't as you yourself pointed out in your question but that doesn't matter for XMP.
