Does the bag stand upright on its own when empty? Does it have any rubber padding underneath?

These are not just a material case - they have good padding on base and the gusset that goes around adjoining the front to back pieces. They also have a generous large front pocket with lots of different sized inside pouches, plus really well padded divider ro make your laptop fit snugly into case. To answer your questions Yes it would if there was no front pocket - but the extra weight obviously makes it lean towards the front. BUT not like a flimsy bag, it does not crumple up and loose it's shape - and no it does not have rubber padding underneath. BUT it is very well made and very tough - we have had ours a few years now and they get carried from a to b hundreds of times. Slid into cupboards etc. and there is no sign of wear or tear on either of them, even at the corners. They have good zips and they offer good protection for your laptop. I would not purchase anything else as we have been really pleased with them.

My laptop is 12.1 will the cake be too big?

No problem, mine is 13" and it fits comfortably. Its a good bag of which I carry my phone and laptop chargers in as well.

Is it waterproof/splashproof?

Splash proof yes but waterproof no. Above the zip compartment at the front is a thicker fabric which is quite rubbery and would probably be waterproof. The rest of the bag is heavy duty, close woven nylon fabric which, although lined inside, would probably not stand a torrential downpour.
